Directive 2002/95/EC of January 27, 2003 on the Restriction of the use of certain hazardous substances in electrical and electronic equipment (RoHS)

Sun is committed to complying with all applicable substance legislation worldwide, including the European Union Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment, Directive 2002/95/EC (RoHS). It is Sun's goal to be in compliance for all electrical/electronic equipment (EEE) products with the EU RoHS Directive by the July 2006 implementation date, and to incorporate these features into our global product lines.

Sun's product specifications also prohibit the use of certain substances such as chlorofluorcarbons CFCs), hydronchlorofluorocarbons (HCFCs), or other substances known to affect the ozone layer (ODSs). Sun's design process helps ensure that our suppliers and manufacturers work from environmentally friendly design standards and specifications. Sun is working with its supply chain to address compliance for all Sun EEE products with the various RoHS directives.

Sun's transition to RoHS compliance will be a process carefully phased in over time and with appropriate validation and auditing. In some instances, the RoHS compliant versions of products may be upgraded with improved functionality, while some older non-compliant products will be discontinued. All newly designed products to be released in 2006 and beyond, with limited exceptions, will be RoHS compliant at time of release.

European Union Directive 2002/96/EC of January 27, 2003 on Waste Electrical and Electronic Equipment (WEEE)

Background
Sun Microsystems, Inc. ("Sun") is focused on developing a compliance program for the European Union ("EU") Directive on Waste Electrical and Electronic Equipment, Directive 2002/96/EC (the "EU WEEE Directive"). Under the EU WEEE Directive, which takes effect on August 13, 2005, manufacturers of covered electronic equipment will be obligated to take back such products at the end of their useful life. The EU WEEE Directive covers Sun's products sold to businesses and private consumers before this effective date (historic products), as well as products that will be sold in the future. In addition, the EU WEEE Directive must be transposed within each of the 25 EU Member States. Transposition by each Member State may vary the requirements of the EU WEEE Directive due to the particular national law that is transposed.

Compliance
Beginning August 13, 2005, Sun will have a product take back program in place which will cover collection, treatment, recovery and disposal of all covered electronic products sold into the 25 EU Member States on and after this effective date.

Sun will comply with the product take back requirements at the end of life of products that are sold into the EU and are Sun-branded. Sun is presently evaluating Sun's compliance efforts related to covered electronic products purchased from Sun suppliers and sold to Sun customers that may ultimately be rebranded and defining the implementation strategy. More information about Sun's policies with regard to its suppliers and customers will be forthcoming soon. In addition, Sun has already embarked on the process of marking and labeling covered products with the crossed-out wheeled bin legend, as required under the EU WEEE Directive. Once incorporated, the wheeled bin legend will be a permanent part of Sun's master agency label, where all other labeling requirements are found.

Sun is committed to meeting or exceeding environmental standards in the production of all Sun products and is engaged in a comprehensive, company-wide effort towards full compliance with the EU WEEE Directive.
