California Electronic Waste Recycling Act
(SB20, as amended by SB50)

The Governor of California signed into law effective January 1. 2005 amendments to the California Electronic Waste Recycling Act of 2003 (the "Act") (also known as Senate Bills 20 and 50). Under the Act, retailers selling certain electronic products defined as Covered Electronic Devices in California must collect an electronic waste recycling fee from the consumer at the time of purchase. Beginning January 1, 2005, Sun Microsystems, Inc. ("Sun") will report and remit fees on all covered electronic devices to the State of California as prescribed by the Act.

Sun's Policy Statement

Sun Microsystems, Inc. (Sun) has elected to absorb the necessary recycling fees from our California end-user customers. This statement will be expressed on all invoices received from Sun.

Notice to Sun Resellers

You may be required to charge this fee to your customers on Covered Electronic Devices purchased from Sun and remit the fee to the State of California. You are responsible for understanding and complying with the Act to the extent applicable to you. Sun will not collect and remit this fee on your behalf if Sun has a California resale exemption certificate on file for you.

Devices Covered Under SB50

Sun and Sun's resellers who make retail sales to consumers must collect recycling fees for the following categories of products:

  • Cathode Ray Tube Devices and Cathode Ray Tubes (CRTs)
  • Computer monitors containing CRTs
  • Liquid Crystal Display (LCD) desktop monitors
  • Laptop computers with LCD screens
  • Televisions containing CRTs

Sun has determined that the following Sun products are Covered Electronic Devices under the Act.

* Above is a list of "covered electronic devices", manufactured by Sun Microsystems, Inc., that are subject to the California electronic waste recycling fee at the time of sale.

Recycling Fees

Beginning on January 1, 2005, retailers must collect from the consumer recycling fees established under the Act upon the first sale of a Covered Electronic Device. The fees for each Covered Electronic Device established under the Act are as follows:

  1. Six dollars ($6) for each covered electronic device with a screen size of greater than 4 inches measured diagonally but less than 15 inches measured diagonally.
  2. Eight dollars ($8) for each covered electronic device with a screen size greater than or equal to 15 inches but less than 35 inches measured diagonally.
  3. Ten dollars ($10) for each covered electronic device with a screen size greater than or equal to 35 inches measured diagonally.

Notification Requirements

Manufacturers of Covered Electronics Devices are required to notify retailers of their products that are covered under the Act

Consumer Recycling Information

Additionally, this legislation requires the retailer to make information available to California consumers regarding how to recycle electronic equipment and display monitors.
