Rules of Engagement

The Upgrade Allowance Program is designed with the understanding that agreed-upon trade-in equipment will be returned to Sun within 90-days of shipment from Sun. This section describes the rules associated with the program.


US Upgrade Allowance Program Rules

UAP Returns Template
As of April 14, 2009, all US Upgrade orders, both Direct and In-direct (Channel Partners), must include a completed "UAP Returns Template". The template contains specific trade-in ("Returns") equipment identified by:
  1. manufacturer
  2. model
  3. qty
  4. equipment description (cpu, disk drives, etc.)
  5. customer's Returns Contact name, e-mail and phone number

90-Day Trade-In Equipment Return Policy
As a condition of purchase of upgrade products, the End User (or agent of the End User) must return all eligible trade-in equipment to Sun within 90 days, beginning from the ship date of the upgrade product. If the End User purchased directly from Sun, then Sun's ship date begins the clock. If the End User purchased through a Channel Distribution Partner (CDP), the clock begins on the date of shipment from the CDP. Failure to return all eligible trade-in equipment will result in additional invoicing for the amount advanced to the end user for the upgrade product and may include a nominal processing fee. Sun will not return product or provide credit for trade-in equipment returned to Sun after the stated 90-day return period or extended return period window.

Upgrade Consolidation Orders
The trade-in equipment required for consolidation orders is defined at the time of order. Sun expects the end user to return all trade-in equipment agreed to at the time of order. Sun will not return product or provide credit for trade-in equipment returned to Sun after the stated 90-day return period or extended return period window.

Requests for Extension of Time
If there are extenuating circumstances that prevent an End User from returning the trade-in equipment to Sun within the 90-day window, the End User must request an Extension. The End User/Reseller must request the Extension prior to the end of the original 90-day return window in order to be considered. Certificates of Destruction
Sun has established a special procedure for End Users that are unable to return trade-in equipment to Sun due to information/security regulations requiring them to destroy trade-in equipment. This procedure addresses situations in which the return of certain equipment to Sun is replaced by a Certificate of Destruction, signed by a Sun Area Controller/Finance Manager for final approval. Invoicing for Failure to Return the Trade-In Equipment
Sun will track the returns of trade-in equipment from end users. The end user must meet the following conditions for compliance with Sun's program rules:
  • The End User must return the trade-in equipment within 90 days of Sun's ship date, or by the extension date, if an extension was requested AND granted.
  • The trade-in equipment must be in operating condition (i.e., Bootable and functional)
  • Trade-In equipment must not be damaged (dented, cracked, rusted, etc.).
  • The type of equipment must meet the requirements identified at the time of order.
  • The quantity of equipment must meet the requirements identified at the time of order.
  • The age of the equipment must meet the requirements identified at the time of order, if an accelerated allowance code was granted.
  • Equipment being traded in must be owned by End User for a minimum of 90 days.
  • In the U.S., Danzas must be used as the pick up service carrier. Government accounts are exempt from this rule and may use government approved carriers.
  • A Certificate of Destruction must be completed by the End User for all equipment not being returned to Sun due to security/government regulations.

Sun will not return product or provide credit for trade-up equipment returned to Sun after the 90-day return period or extended return period window.

Sun will invoice the responsible Direct customer or CDP for End Users who purchased the upgrade product through a Reseller. The CDP is responsible for collecting the invoice amount from the Reseller or End User.

Packing
Trade-up equipment should be packed in boxes. If the trade-up equipment does not fit into the new equipment box(es), Sun pays for packaging from Sun's freight vendor (Danzas). Each carton or pallet must have a shipment address label attached to it and be listed on the Bill of Lading.

Freight
Sun's freight company will confirm pickup request within 2 business days. It may telephone the contact person for additional information. Sun pays freight charges. Sun's freight company will pickup the packaged equipment from a loading dock. If the customer cannot get their equipment to a loading dock, then the customer must make arrangements to get the packaged equipment to the loading dock. They can do so with Sun's Freight Vendor or the vendor of their choice at their own expense. In addition, any special handling requirements are at the customer's expense.
