Statement of the Lawsuit
Sun Statement re: Appellate Brief (March 07, 2003)Today Sun Microsystems filed its brief in response to Microsoft's appeal of the preliminary injunctions granted to Sun by Judge Frederick J. Motz in the company's antitrust lawsuit against Microsoft. See http://www.sun.com/lawsuit for details on the injunctions. The Judge issued his decision on December 23, 2002 and his order instituting the injunctions on January 21, 2003. Microsoft then filed an appeal with the 4th Circuit Court of Appeals. The 4th Circuit will hear arguments regarding this appeal on April 3, 2003 in Richmond, VA. "The facts and the law strongly support Judge Motz's thorough, well-reasoned decision," said Lee Patch, vice president, legal affairs, Sun Microsystems, Inc.
