FOREIGN NATIONALS

ALERT

EXPORT LICENCES MAY BE REQUIRED FOR FOREIGN NATIONALS

The U.S. Export Administration Regulations provide that the release of technology or software to a foreign national is an export. A foreign national is anyone who is not a U.S. citizen, U.S. permanent resident alien, or a lawfully admitted refugee or asylee. Exports occur in everyday disclosures of information to foreign nationals via consultation, training, company visits, and conversations through e-mail, fax and telephone.

A federal export licence must be secured BEFORE disclosing certain kinds of software or technology to a foreign national who works in an engineering capacity and who is from any of the "proscribed" countries listed below:

Employment categories may include: regular workers, contingent workers, temporary workers, contractors, vendors, interns, externs (unpaid interns who earn credits) and visiting professors. Export licenses are free of charge but can take 3 or more months to obtain. Failure to contact International Trade Services in a timely manner for an export license application may result in a delayed start date. Due to timing of licensing, and the fact that internships and externships are for a limited time period, Sun may not be able to obtain licenses in time for the individual to participate in the internship program.

Sun generally does not engage contingent workers (e.g. Temps and contractors) in positions that would require Sun to obtain a license. Sun will work with the vendors who supply workers in those positions, to ensure that the appropriate licenses are obtained. Labor Suppliers are contractually obligated to bring the need for licensing to Sun's attention.
