CORPORATE EXPORT COMPLIANCE POLICYSun Microsystems, Inc. May 1, 2006 SUN CORPORATE EXPORT COMPLIANCE STATEMENT Sun Microsystems and its employees take pride in providing the world with state of the art technology, hardware, software and services without compromising U.S. and other national export control laws. Sun's products and services assist our customers in growing their businesses and managing their operations on a global basis. Export compliance plays an important role in ensuring our success and that our customers and business partners. Compliance with U.S. export control laws and regulations which govern not only the export of tangible products, but also the transfer/export of intangible products (e.g. software, technology, know-how) is the unequivocal policy of Sun Microsystems, Inc. and the responsibility of all Sun employees. No transaction that is contrary to this policy shall be executed under any circumstances. All Sun employees must take special care to prevent transactions with persons and organizations involved with terrorism or development of weapons of mass destruction, with embargoed countries, and with persons denied export privileges. Violation of the U.S. export laws by Sun employees may result in disciplinary action, up to and including termination of employment. In addition, potential consequences imposed by the government on Sun and its employees can include fines, imprisonment, and loss of Sun's corporate export privileges resulting in the loss of more than half of Sun's current revenue. Any questionable transaction should be placed on hold immediately. Questions regarding the legitimacy of a transaction should be referred to the Sun International Trade Services Department for immediate attention. I fully support the efforts of the Sun International Trade Services Department to educate Sun employees and to ensure Sun Microsystems Inc. remains in compliance with U.S. and other national export control laws. In these times of increased uncertainty in the international environment, export compliance becomes more important than ever. Please make every effort to work with International Trade Services to ensure the protection of Sun's export privileges and the continued success of our business. Remember, export compliance is the responsibility of every employee. While ITS can provide the policies and processes we need to comply with the law, the responsibility to understand and follow those policies and processes in performing our day-to-day jobs is shared by all of us.
