Application For Sun Academic Initiative Programs

Please read this application and the agreements and terms and conditions referenced in this application carefully. By submitting this application, you agree that (a) the information contained in this application is accurate and complete; (b) you are authorized to submit this application on behalf of the organization listed in Section 1 below and to bind such organization to the terms and conditions set forth in this application and in the agreements and terms and conditions referenced in this application; and (c) if your organization is accepted into any of the Sun Academic Initiative Programs, its participation in such Sun Academic Initiative Programs will be subject to the terms and conditions set forth in this application and in the agreements and terms and conditions referenced in this application.

Please note that, in order to receive the services under the Sun Academic Initiative Programs, students and other eligible users of the services will be required to provide personal information to Sun and its third party service providers, and Sun and its service providers will have to process and use such information about students and other eligible users.

   Please complete either (a) or (b) below:

A. Nonprofit Organizations. Only certain nonprofit organizations are eligible to participate in all Sun Academic Initiative Programs. You acknowledge and agree that the organization listed on this application is classified as exempt from taxation by the Internal Revenue Service under Section 501(c)(3) (or by an equivalent taxing authority under an equivalent tax law, regulation or ordinance for the country in which such organization is located) and is:
  
    a nonprofit education institution whether public or private (including elementary schools, middle schools, high schools, colleges, universities and graduate schools)
    a nonprofit association, consortium or organization which acts on behalf of member nonprofit or public educational institutions
    a nonprofit teaching hospital affiliated with a teaching institution
    a nonprofit private or public library system
    a nonprofit private or public museum
    a nonprofit research institution
  

Please note that Sun may require you to provide documentation to verify your organization's status as a nonprofit organization.


B. Certain For Profit Organizations. Only certain for profit organizations are eligible to participate in the Sun Learning Connection Web Course Offering of the Sun Academic Initiative Program. Sun Learning Services has the right to approve or deny a for profit organization. You acknowledge and agree that the organization listed in this application is:
    an education institution whether public or private (including elementary schools, middle schools, high schools and graduate schools)
    an association, consortium or organization which acts on behalf of member nonprofit or public educational institutions
    a teaching hospital affiliated with a teaching institution
     a private or public library system
    a private or public museum
     any department of education, ministry of education, local school board or district
    a research institution

Terms, Conditions and Termination

Does your organization have a valid, existing agreement with Sun under which it may purchase educational services from Sun?

  		   Yes, the organization listed in this application has a valid, existing agreement with Sun for the purchase of educational services from Sun. By submitting this application, you agree that such organization's participation in the Sun Academic Initiative Programs is subject to the terms of such agreement and the terms of such agreement are hereby incorporated by reference in this application. You understand that, if Sun is unable to verify the existence of such valid, existing agreement, this application will be rejected.    
  
General Terms and Conditions Agreements
  

  		  You must agree to Sun's General Terms and Conditions and Purchasing Exhibit applicable to the country in which your organization is located and published online in order to participate in the Sun Academic Initiative Programs. If your country is not listed on such web site, you must agree to Sun's General Terms and Conditions and Purchasing Exhibit for the United States which are published online in order to participate in the Sun Academic Initiative Programs.    
  

You have read and understand the Sun General Terms and Conditions and Purchasing Exhibit referenced above. By submitting this application, you agree that such General Terms and Conditions and Purchasing Exhibit (1) will govern your organization's participation in the Sun Academic Initiative Programs, and (2) are incorporated by reference in this application.
  
Termination

  		  You understand and agree that Sun may terminate your organization's participation in all or any portion of the Sun Academic Initiative Programs without cause immediately upon notice to one of the contacts listed in this application. You further agree that Sun will not be liable for any damages arising out of the termination of your organization's participation in the Sun Academic Initiative Program.    
  

You understand that the information in this application will be used, in part, to determine your organization's qualifications as a participant in the Sun Academic Initiative Programs. You understand that while this information is an integral part of the selection process, submission of this application does not automatically qualify your organization as a participant in any of the Sun Academic Initiative Programs. Your organization is not authorized to participate in any of the Sun Academic Initiative Programs until it receives written acceptance into such Sun Academic Initiative Program(s) from Sun.
