Sun Microsystems' Why I Love Solaris Story Sweepstakes

OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED BY LAW.

1.    HOW TO ENTER. To enter, fill out an entry form online and tell us your Solaris story in the space provided. Submit the completed entry form online. The email address and phone number supplied on the entry form must be valid in order to enter the contest. Illegible, incomplete, or inaccurate entries, and entries submitted by mail or facsimile are void. Subject to all applicable federal, state, and local laws and regulations.

2.    THE SOLARIS STORY. Your Solaris story must be in English and contain at least four (4) sentences related to Solaris. Your story can be factual or fictional and should be related to Solaris. Stories should be submitted according to monthly themes posted quarterly to our contest site. Stories submitted that are not related to the posted theme for each ENTRY PERIOD will still be considered and do not effect the submitter's entry or chances in the drawing. Do not include any company confidential information or details that may be inappropriate to share with the general public. You are expressly prohibited from violating any third party intellectual property rights, including copyright or trademark, or from engaging in unlawful or unsportsmanlike conduct in telling your story. Any intellectual property rights in your Solaris story will remain yours. We will ask you for permission to use your name or company name with your story on Sun's website and/or in other marketing promotions related to Solaris, but do not guarantee usage of your story. We may list your story on this site and in other marketing promotions anonymously. We may award you an Apple iPod at our discretion. Whether or not we select or post your story and whether or not you give us such permission will not affect your chances of winning the Sweepstakes.

3.    ENTRY PERIODS. The Drawing has eight entry periods (each an "Entry Period") as set forth below.

You must submit your entry online by 11:59 pm PT on the End Date of the Entry Period. Entries received after 11:59 pm PT on the End Date for the above identified First through Seventh Entry Periods will be entered into the following Entry Period; and entries received after 11:59 pm PT on the End Date for the Eighth Entry Period will not be considered. You can enter multiple times during each Entry Period, provided that you do not use the same story twice in any submission. Each story submitted must be unique and self-contained. Each unique and self-contained story can only be entered into one Entry Period.

4.    DRAWING. At least two winners will be selected each Entry Period from all eligible entries received by a random drawing conducted electronically by Sun at the conclusion of that Entry Period. There will be at least a total of sixteen (16) winners. Sun's decisions in the drawings are final and binding. The winner will be notified by email and/or telephone on or around the Winner Selection date identified above and will have ten (10) days to claim the prize. If the potential winners do not claim the prize within this time period or if the entry is found to be ineligible for any reason, Sun will select an alternate winner from the same pool of entrants.

5.    PRIZES, ODDS OF WINNING. The prize each Entry Period may include one (1) Apple iPod song player. This prize has an approximate retail value of US$230.00 or greater. Prizes given at Sun's discretion. The Apple iPod song player prize includes headphones for the song player, CD with iTunes for Mac and Windows and features guide, dock adapter, and QuickStart guide, but does NOT include any songs or additional memory. Odds of winning depend on the number of eligible entries received. The winner is not permitted to substitute the prize or receive its cash equivalent. Sun reserves the right to substitute the prize with a prize of similar or greater value at its sole discretion. Prize may not be assigned or transferred. Winner is solely responsible for any and all applicable fees and taxes associated with prize receipt and use. All other expenses and costs not expressly listed above are solely the winner's responsibility.

Allow 6-8 weeks for delivery of prize once Sun has received your affidavit of eligibility. (See section 9 below.)

6.    ELIGIBILITY. To enter you must be a legal resident of the country in which you reside (except for residents of any country that is currently embargoed under U.S. export control laws, including but not limited to: Afghanistan, Cuba, Iran, Iraq, Libya, North Korea, Sudan, and Syria) and must be 18 years of age or older as of the start of the Entry Period. Employees or agents of Sun Microsystems, its affiliates, subsidiaries, or their service agencies or independent contractors and persons who are or were engaged in the development, production, distribution of materials, or drawing of the winner for this Sweepstakes and such persons' immediate family members are not eligible to participate or win the prize.

7.    ADDITIONAL CONDITIONS. By entering this Sweepstakes, entrants agree to: (a) be bound by these official rules and by Sun's decision relating to this Sweepstakes; (b) release and hold harmless Sun, its affiliates, dealers, subsidiaries, and their service agencies and independent contractors, and their respective directors, officers, employees, and agents, including advertising and promotion agencies, from any and all liability with respect to acceptance, possession or use (or misuse) of the prize or participation in this Sweepstakes. Sun and its agencies are not responsible for illegible, incomplete, lost, late, damaged, destroyed, or misdirected or unintelligible entries. Sun reserves the right to cancel or modify the terms of this Sweepstakes if fraud, technical failures or any other factor beyond Sun's control impairs the integrity of this Sweepstakes, as determined by Sun in its sole discretion. Sun reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or to be acting in violation of these Official Rules.

8.    LIMITATION OF LIABILITY. Sun and its agencies are not responsible for any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of submissions in the Sweepstakes. Sun and its agencies are not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sun and its agencies are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software or failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participant's or to any other person's computer related to or resulting from participating in the Sweepstakes.

9.    AFFIDAVIT OF ELIGIBILITY, LIABILITY/PUBLICITY RELEASE. The winners will be required to sign and return an affidavit of eligibility and liability/publicity release (the "Affidavit-Release"), where legal, in order to claim the prize. In the event the Affidavit-Release is not signed and returned to Sun, the winner will be disqualified, and Sun will select an alternate winner from the same pool of entrants. By accepting the prize, except where prohibited by law, winner agrees that Sun may use his/her name, address, city, state, photograph, videotape or any other likeness, for advertising or publicity purposes, and use statements made by or attributed to him/her relating to Sun or this Sweepstakes (provided same are true), without notice or further compensation to the winner.

10.   ENTRIES, PERSONAL INFORMATION. All submitted entries are the sole property of Sun and will not be returned. The information collected from entrants is subject to Sun's privacy policy, which is located at http://www.sun.com/privacy.

11.   WINNER NAME, OFFICIAL RULES. To receive the name of the winner (available 30-45 days after the end of each Entry Period), or a copy of the Official Rules send an email from your computer with a clear return physical email address to us indicating "winner name" or "contest rules" in the body of the email. Allow 5-7 days for a response.

12.   SPONSOR. This Sweepstakes is sponsored by Sun Microsystems, Inc., with offices at 4150 Network Circle, Santa Clara, CA 95054.

13.   DISPUTES. Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, other than its administration, shall be resolved individually, without resort to any form of class action, and exclusively by a court having competent jurisdiction located in the County of Santa Clara, California, U.S.A.; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sun in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without giving effect to any choice of law or conflict of law rules.
