This unique program is designed to help you choose the right products in the easiest way possible: a free 60-day product trial with a no-problem return policy, no cost for shipping either way, and full support. But there are some rules and responsibilities, and we ask that you follow them.

How to Apply and Qualification Criteria

Items needed for a successful application process: Acceptance of the Sun Try and Buy Agreement Acceptance of the U.S. Export Control Agreement Complete contact, bill-to and ship-to information, including Company Tax ID, VAT/GST or Company Registration Number

Once an application is submitted, it will be reviewed by Sun Microsystems against these criteria: Confirmation of accurate and complete contact, bill-to and ship-to information Sun credit check * Export control

You will be contacted by Sun on your application status within five business days of submitting your application.

NOTE: If you choose to return the product, it must be returned in its original packaging and condition. All data must be removed from all the system disks. Sun is not responsible for any data left on returned systems.

* IMPORTANT NOTE FOR INDIVIDUALS ONLY: After the completed application form is received, consumers/individuals will be contacted by Sun Microsystems and asked to provide a credit card number that will be used for pre-authorization and subsequent billing, if the system is purchased. Consumer applications and credit card processing is only available in the following countries: Australia, Austria, Canada, Germany, New Zealand, UK, and US. For the other Try and Buy Program countries, consumer applications are not able to be processed at this time.

FOR ALL OTHER APPLICANTS: Neither Purchase Orders (POs) or Credit Cards are required for company, government, education or Sun Authorized Partner submitted applications.

Program Definition

• Free 60-day trial period for selected system.
• System, unless noted, comes with standard warranty support for the trial period.
• System, where noted, comes pre-loaded with Solaris 10 and the right to use (RTU) it during the trial period for evaluation purposes.
• Applicant (end user or partner) will be quoted for the system selected. Quotes will reflect the system buy price and include any additional charges that a normal system purchase would include, ie) shipping, taxes, etc. Country level list pricing is available at: http://catalog.sun.com/
• Applicant (end user or partner) buys or returns that exact system selected for the trial at the end of 60 day trial period.
• Applicant (end user or partner) is responsible for loss, theft or damage to the system during the trial period.
• Applicant (end user or partner) shall not copy, reverse engineer, disassemble or decompile any trial systems.
• 60-day time line starts from the date of system shipment from Sun Microsystems.
• If returning, applicant (end user or partner) calls for RMA# per instructions posted and provided in emails during the trial period. System needs to be boxed in original packaging and sent back to Sun Microsystems. Sun Microsystems pays for return shipping.
• If purchasing, applicant (end user or partner) provides Sun Microsystems with a purchase order (PO) number to invoice against or a credit card number for direct charging.
• If purchasing, the warranty period for the purchased system restarts at the date of actual purchase.
• If applicant (end user or partner) has not purchased or returned the system, an invoice will automatically be sent. The user or partner is obligated to pay for the system per the Try and Buy Agreement agreed to on the web-based qualification form.
• If applicant (end user or partner) does not pay the invoice, Sun Microsystems will take necessary actions to secure payment or return of the system.
• Sun Microsystems retains title to the system during the trial period until the system is purchased.
• All applicants must agree to the Try and Buy Agreement

Eligibility:

• Sun Authorized Partners (ISVs and others)
• Consumers/individuals *
• Sun employees are NOT eligible to participate in the Try and Buy Program, nor are they allowed to complete the application on behalf of a company or Sun Authorized Partner. Applications completed by Sun Microsystems employees will be denied.

Countries Supported

• For consumers/individuals:
  Australia, Austria, Canada, Germany, New Zealand, United Kingdom, and United States of America. It is only valid in countries listed above. Country list may be changed without notice.
• For companies:
  Australia, Austria, Belgium, Canada, Colombia, Denmark, Finland, France, Germany, Hungary, Italy, Japan, Mexico, Netherlands, New Zealand, Norway, South Korea, Spain, Sweden, Switzerland, United Kingdom, United States of America, Venezuela. For companies in Italy, Japan, South Korea, Hong Kong, and Taiwan applications will be handled in conjunction with a Sun Authorized Partner. It is only valid in countries listed above. Country list may be changed without notice. For securing a trial system in countries other than listed, please contact your Sun sales office.
• Sun Authorized Partners:
  Australia, Austria, Belgium, Canada, Colombia, Czech Republic, Denmark, Finland, France, Germany, Hong Kong, Hungary, Italy, Japan, Korea, Mexico, Netherlands, New Zealand, Norway, Poland, Spain, Sweden, Switzerland, Taiwan, United Kingdom, United States of America, Venezuela. It is only valid in countries listed above. Country list may be changed without notice. For securing a trial system in countries other than listed, please contact your Sun sales office.

Application and Order Limits:

• For companies: One (1) system per application, with a maximum of five (5) systems outstanding at any one time per company. A company is defined as a legal entity. ie) If a parent company operates with multiple legal entities worldwide, each legal entity is allowed a maximum of five (5) systems outstanding. The Sun credit check for approval of the application will be done at the legal entity level.
• For Sun Authorized Partners: One (1) system per application, with a maximum outstanding at any one time of ten (10) systems or the number of systems available within the Sun Authorized Partner's available credit line with Sun Microsystems, whichever is less.
• For consumers/individuals: One (1) system per application, with a maximum of one (1) system outstanding.

Special Discounted Pricing Promotion

Buy your Sun Try and Buy trial system once you've completed your testing at 25-45% off Sun's list price. Discounts vary by product and final pricing will be stated in your quote from Sun or a Sun Authorized Partner.

• Select CMT Servers are offered at 45% discount off of list price: Sun Fire T2000 Server, Sun SPARC Enterprise T5220 Server, and Sun SPARC Enterprise T5120 Server
• All other Try and Buy systems offered at 25% off of list price, unless stated otherwise.

How to Buy at Discounted Promotional Prices

All approved Try and Buy Program participants who buy their trial unit during the eligible promotion period will be quoted and able to purchase at the discounted pricing. There are no additional forms or qualification criteria needed.

Promotion Eligibility Period

January 15 - June 30, 2008.
The promotion applies to all trial system purchases made from January 15 - June 30, 2008.
NOTE: Eligibility period applies to the date of the purchase of the trial system. The date that you initiated your trial is irrelevant, so long as you buy the trial system by June 30, 2008. Trials started during the eligibility period, but not purchased by June 30, 2008, are not eligible.

Definition of a Purchase

When purchasing via Purchase Orders:

• For purchases direct from Sun Microsystems by end users: There must be a Purchase Order dated no later than June 30, 2008, made out to Sun Microsystems. The Purchase Order MUST reference the Try and Buy application number (starts with "TBWEB").
• For purchases by end users through their Sun Authorized Partner: Partners must have a Purchase Order from the end user to the Sun Authorized reseller dated no later than June 30, 2008. The Purchase Order MUST reference the Try and Buy application number (starts with "TBWEB").

When purchasing via Credit Card:

• For purchases direct from Sun Microsystems by end users: The credit card transaction must take place no later than June 30, 2008.
• For purchases by end users through their Sun Authorized Partner: The credit card transaction must take place no later than June 30, 2008.

Terms and Conditions

• Special discounted prices apply to all systems offered through the Try and Buy Program.
• Special discounted prices apply ONLY to APPROVED free trial applications.
• Special discounted prices are ONLY applied to the specific unit being trialed in the exact configuration through the Try and Buy Program. It does NOT apply to any other or subsequent purchases of like products. It does not apply to modified configurations of the trial unit. Nor does it apply to any purchases of Sun products outside of the Try and Buy Program.
• A unique Try and Buy Program tracking/application number that is issued for all trials, identified as a 'TBWEB#', is required on all quotes and invoices of the trial unit for the promotional pricing to be offered and valid.
• Promotional pricing is available direct from Sun or through Sun's Authorized Reselling Partners. Sun's Authorized Partners will issue quotes for pricing available through them.
• All existing terms and conditions of the Try and Buy Program as outlined in the Official Program Rules and the Try and Buy Program Agreement apply.
• Offer is valid only in countries where the Try and Buy Program is offered, as listed on www.sun.com/tryandbuy. Void where prohibited.
• Promotional discounted pricing CANNOT BE COMBINED with any other special offers or promotions.
